Herein is the Ex Parte Application for Order of Protection filed by Anthony R. Friedman d/b/a Friedman Law Firm LLC (petitioner) naming Albert B. Pepper Jr. d/b/a Phoenix Rising Productions LLC (respondent) filed in the 11th Judicial Circuit of St. Charles County Missouri on April 9, 2026 (Case #2611-PN00554)
On May 13, 2026 Hon. William Byrnes during a motion hearing granted Respondent Pepper’s Motion To Dismiss With Prejudice and dissolved the temporary ex parte order and barred Friedman from ever asserting those meritless claims again under Missouri Supreme Court Rule – 67.01.
“[A] dismissal with prejudice bars the assertion of the same cause of action or claim against the same party.”
When you read the full disclosure, the petition, the motion to dismiss and the evidence submitted to the court for consideration by the Respondent it is evident that the Petitioner was attempting to use the Missouri Statutes governing Ex Parte orders of protection (RSMo §§ 455.005–455.085) as an attempt to obtain “prior restraint” of free speech of a critic.
The Ex Parte application was not only meritless but reckless which created a multitude of consequences for Friedman with regard to additional Missouri Model Rule (rule 4) violations. Criminal allegations of perjury that will be submitted to the Prosecuting Attorney of St. Charles County Missouri for consideration and civil tort liability for abuse of process, and defamation per se by Petitioner, Anthony R. Friedman, attorney Mo. Bar Number 65531 d/b/a Friedman Law Firm LLC.
Any referring counsel or those considering entering into a fee sharing agreement with Friedman would be well advised to give thorough consideration to the possibility of “Negligent Referral Liability” whereas Friedman is currently under investigation by the Office Of Chief Disciplinary Counsel and his professional and business conduct is being monitored, tracked and documented including that of any fee sharing or co-counsel relationships.
